Terms and Conditions

These Terms and Conditions form the basis of Your contract with Us. We encourage You to read these Terms and Conditions carefully as they apply to all bookings that You make with Us, unless otherwise specified.

 

Definitions

“You” (referred to as “you” or “your”) means the individual that has booked an Excursion and any party named in that booking.

“Excursion Confirmation” refers to an email or document confirming that You have booked an Excursion and details of that Excursion.

“Company” (referred to also as “we”, “us”, “our” and “the Company”) refers to Senior Excursions Limited located at 19 Leyden Street, London, E1 7LE. The registered company number is 13959201.

“Excursion” refers to a day trip provided by Us.

“Representative” refers to an employee or authorised agent of Senior Excursions.

“Tour Manager” refers to a dedicated individual engaged by Us who will be in charge on the day of the Excursion.

“Media” refers to any photographs, videos, podcasts, sketches, brochures, posters, leaflets, documents created by the Company. This list is not exhaustive.

“Website” means the Company website accessible at www.seniorexcursions.co.uk and any other site or online system, software and content under the control of the Company.

“Company Credit” refers to a credit offered by Us to You. This can be used to purchase other Excursions with Us.

“Pick Up Point” refers to the precise location whereby You will be collected from, and returned to,  on the day of the Excursion.

“Door-to-Door Service” refers to the extra optional service offered by Us whereby we collect You and drop You off at Your home address on the day of the Excursion, subject to any specific terms and conditions or restrictions as advised by Us.

“Itinerary” refers to the outline of the day, including the estimated timings, activities and destinations of the Excursion.

“Designated Location” refers to the location at which an Excursion will start and end.

“Terms and Conditions” means these Terms and Conditions.

 

This Agreement

These Terms and Conditions comprise the basis for a legally binding contract made between You and Us when You pay for Your booking in full and We have sent You the Excursion Confirmation by email, post or by confirming the details via the telephone with You.

We will endeavour to send you the Excursion Confirmation within 7 days of Your booking being confirmed. Any information that We send to You regarding a booking or an Excursion must be checked carefully by You as it will contain important information about Your booking and the Excursion. If any details regarding Your booking are incorrect, You must contact Us within 7 days of receiving the Excursion Confirmation or if earlier, at least 2 days before the date of the Excursion. We do not accept liability for any incorrect or inaccurate information) if You did not notify us of the issue as detailed above.

 

Information

All information contained in Our Media is to the best of our knowledge accurate and credible upon publication. We do not accept any liability for any errors or omissions in Our Media.

 

Booking

You can book an Excursion online on Our Website, by telephone, by email or in person with one of Our Representatives.

Your booking will be confirmed by the issuing of an Excursion Confirmation showing your booking details. The Excursion Confirmation will be issued to you by way of email or hard copy. You must provide or show a valid Excursion Confirmation on the day of the Excursion to the designated Tour Manager or Our driver in order to board the vehicle.

 

Payment

Full payment for an Excursion is required at the time of booking. Payment can be made in cash, credit or debit card.

The individual making the booking is responsible for paying for all of the people on that booking.

 

Cancellation

You can cancel Your booking at any time before departure. Should You wish to cancel Your booking, You may do so by email or by telephone.  In the event that You cancel a booking, we are not obliged to refund or compensate You. We do not offer a refund for cancelled bookings. If You cancel a booking, We will endeavour to re-sell Your place on the Excursion. In the event that We successfully re-sell all of the places booked under Your Booking, we will issue You with a Company Credit or a refund.

 

Alteration by You

If, after making Your booking, You wish to alter any named parties on Your booking, You must do so by contacting Us by email or by telephone. Changes to named parties is free of charge and must be done so later than 48 hours before the start of Your Excursion.

If, after making Your booking, You need to change Your Door-to-Door Service location (if you have opted for this additional service) , You must do so no less than 7 days before the Excursion. Any alterations by You, requesting a different location will be accommodated by Us only if We have the availability to do so and if the new location is within a distance and location accepted by Us. If We are unable to accommodate this change, the Pick Up Point confirmed in the Excursion Confirmation will prevail. Any alteration of the Door-to-Door Service may be subject to an additional charge, We will inform You of this charge at the time of Your request and the charge will be payable by You within 3 days of the request or if earlier, no less than 48 hours before the Excursion date. If You do not pay the charge, then the Door-to-Door Service will not be provided and the Pick Up Point confirmed in the Excursion Confirmation will prevail.

If, after making Your booking, You wish to add the Door-to-Door Service to Your booking, You must do so no less than 7 days before the Excursion. The addition of the Door-to-Door Service will be subject to the door-to-door charges, We will inform You of this charge at the time of Your request and the charge will be payable by You within 3 days of the request. If You do not pay the charge, then the Door-to-Door Service will not be provided and the Pick Up Point confirmed in the Excursion Confirmation will prevail. Should You wish to make any changes to Your booking, please advise Us as soon as possible. We will endeavour to make Your changes however we cannot guarantee that Your changes will be made.

 

 

Cancellations and Alterations By Us

We reserve the right in any circumstances (including failure to reach a sufficient number of participants) to cancel an Excursion. In the event that an Excursion is cancelled, We will return to You all of the money that You have paid to Us for the Excursion or We will offer You a similar alternative Excursion. In the event that an Excursion is cancelled by Us and You have accepted either of the following remedies detailed above, or an alternative remedy agreed between You and Us, We will be exempt from any further liability.

Our Excursions are planned in advance and as such sometimes minor amendments are unavoidable and/or necessary. We reserve the right to amend trips as and when deemed appropriate by Us. If We alter an Excursion, We will endeavour to inform You at the earliest convenience. We reserve the right to change the size or specification of the vehicle being used for an Excursion at our liberty.

 

Extraordinary and Unavoidable Circumstances

Except where explicitly stated in these Terms and Conditions, We do not accept liability or obligation to pay compensation whereby the performance or prompt performance of Our contractual obligations to You are prevented or affected and You suffer any damage, loss or expense of any nature, as a result of unavoidable and extraordinary circumstances. Unavoidable and extraordinary circumstances refer to situations that are beyond Our control or knowledge and include consequences that could not have been avoided even if all reasonable measures had been taken.  We accept no liability for any loss incurred if an Excursion does not go ahead due to extraordinary circumstances or unavoidable circumstances.

 

Itinerary

Each Excursion will be accompanied by an Itinerary which details the anticipated timings of the day. The Itinerary of each Excursion cannot be guaranteed and may change on the day. We reserve the right to alter an Itinerary as and when We consider it necessary or when circumstances beyond Our control force the change upon Us. Sometimes it is necessary to change the Itinerary due to traffic, weather, road or other conditions. We retain the right to alter the Itinerary at our liberty at any time. We will endeavour to inform You of any changes to the Itinerary. We do not accept any liability for any delays caused by a change in Itinerary, this includes any distress, disappointment, inconvenience or effect on other arrangements.

 

Designated Start/End Location

Each Excursion will start and end at the same location, the Pick Up Point, which will be specific to each Excursion. If You have not booked a Door-to-Door service the Pick Up Point will be Your start and end point for the Excursion. Your Excursion Confirmation will detail the Designated Location for that Excursion as well as the time that You must be at that location unless otherwise indicated.

 

Pick Up Points

We offer a specified collection point for each Excursion whereby Our transport can collect You on the way to the destination. The list of collection points is specific to each Excursion and will be available to view at the time of Your booking. It is Your responsibility to arrive at the Pick Up Point by the time specified for the Excursion. You are responsible for any travel to or from the Pick Up Point. Your Excursion Confirmation will detail the location of Your Pick Up Point as well as the time that You must be there.

 

Door-to-Door Service

We offer an extra optional door-to-door service on the day of each Excursion. This service is subject to Your location and additional charges. The door-to-door service allows You to be collected from Your home address before the Excursion and dropped off at Your home address after the Excursion. If You would like to add the door-to-door service to Your booking, You must inform us at the time of booking or within 7 days following this or if earlier, no later than 7 days before the Excursion date. Door-to-door services are subject to availability. We cannot guarantee that We can offer this service on the day of the Excursion. If You have requested the door-to-door service and We have confirmed that We can offer this to you, We will inform You of the time that You will be collected and dropped off on the day of the Excursion. You’re responsible for ensuring that You are ready to leave your home address at the time noted on the day of the Excursion.  In the event that You will not be ready in time, You must contact us by telephone, at least 30 minutes before Your scheduled pick-up time. We are not obliged to wait for You, but if the circumstances on the day permit it, We might be able to wait for a reasonable time. On the day of the Excursion, you will be dropped off at Your home address after the Excursion has concluded.

 

Missed Departure

Your Excursion Confirmation shows the details of Your Pick Up Point and the time. You are responsible for ensuring that You are at the correct pick-up point at the correct time on the day of the Excursion. If a Pick-Up Point and/or time is not detailed on Your Excursion Confirmation, We will contact You by telephone or by email at least 7 days prior to the Excursion. In the event that You will arrive late to Your Pick Up Point, You must contact us by telephone, at least 30 minutes before Your scheduled pick-up time. We are not obliged to wait for You, but if the circumstances on the day permit it, We might be able to wait for a reasonable time. However, We are not responsible or liable for Your failure to arrive at the correct Pick-Up Point and/or at the correct time. In the event that You arrive late or do not arrive at the pickup point, We are not liable for Your missed departure. In the event of Your missed departure, We are not obliged to refund Your booking. You will not be entitled to any claim against Us if You arrive late to Your Pick Up Point.

 

Mini-Bus or Coach Breakdown

In the event that Our transport breaks down or is unavailable on the day of the Excursion, We will endeavour to provide alternative transport arrangements. We will endeavour to do so, within sufficient time to allow the Excursion to go ahead with as little impact as possible.  In the event that the breakdown or unavailability of transport has a major impact on the Excursion, We will offer You a refund of all money paid by You to Us for the Excursion or a similar alternative Excursion. Once this offer has been made to You, We will be exempt from any further liability. We have the liberty to decide what constitutes a major impact on an Excursion.

 

Seating

Seats of the mini-bus or coach may be allocated for an Excursion. If seats are allocated, Your seat numbers will be included in Your Excursion Confirmation. We will endeavour to seat all parties on Your Booking as closely as possible to each other. However, in some circumstances, this may not be possible. Seat allocation is not guaranteed. In the event of certain circumstances such as a change in transportation, We may reallocate seats. We may allocate, re-allocate and unallocate seats as and when We consider it necessary.

Seat Belts

You must use the seat belts on the mini-bus or coach at all times while You are in the vehicle. We are not responsible nor are We liable for any injury, loss or damage caused as a result of Your failure to wear a seat belt.

 

Smoking and Alcohol

Smoking is strictly prohibited on Our vehicles at all times. The consumption or carrying of alcoholic drinks is strictly prohibited on the vehicle without the express permission of Us. If You or a named party on Your booking consumes alcohol during an Excursion, You accept that this is done at Your own risk. The excess consumption of alcohol on an Excursion is prohibited. In the event that We consider Your alcohol consumption to be in excess then We have the right to remove You from the Excursion. In the event that You are removed from an Excursion for this reason, You will not be entitled to a refund or any claim against Us.

 

Animals

No animals are allowed on Our vehicles or on an Excursion. Exception for Guide Dogs can be accommodated at a minimum 7 days’ notice.

 

Personal Property

We are not responsible for any loss or damage to Your personal property. Any personal property that You bring on an Excursion is Your sole responsibility.  Any items left in the vehicle during an Excursion are left at Your own risk.

 

Special Requests

If You have a special request, We will endeavour to accommodate this, however, We cannot guarantee that it will be fulfilled. If You have a special request, You must inform us of the request before making Your booking.  Any of Your special requests will be passed on to the relevant third party involved in Your Excursion where possible (e.g., dietary, accessibility). We cannot guarantee that Your requests will be honoured. We cannot guarantee that we will be able to inform you about the success of Your request before the Excursion commences. All special requests are subject to availability and practicality. An additional charge may need to be added.

 

Health Considerations, Disability and Reduced Mobility

You are responsible for ensuring that You and any parties named in Your booking have the appropriate health, mobility and mental capacity to participate in the Excursion as described in the Excursion Confirmation. If You or a member of Your booking have any medical conditions or disabilities that may affect Your Excursion or the Excursion, We encourage you to advise Us prior to Your booking so that we can discuss and You can decide upon the suitability of the Excursion.

If you intend to bring a mobility scooter, wheelchair, or frame with you on an Excursion You must notify us of this at least 7 days before the Excursion. We endeavour to assist You with such where possible, but we cannot guarantee this. You are responsible for your own mobility scooters, wheelchairs and frames and You must be available to advise Our driver about the assembly/disassembly of the item so that it can be stored properly. We are not responsible for any loss or damage caused to Your mobility scooter, wheelchair or frame, even in the event that it was damaged during Our assembly/disassembly. If You are bringing a mobility scooter, this must weigh no more than 15kg and must fold down for storage on the vehicle. When making Your booking You must inform us that You intend to bring a mobility scooter. If You are not able to dismantle and stow the scooter in the luggage area of the vehicle, We will endeavour to help.  We do not accept any liability for any damage or loss arising from You bringing a mobility scooter, wheelchair or frame on an Excursion.

If You or a member of Your booking requires assistance then You or they must be accompanied by an able-bodied friend or carer during the Excursion, unless agreed otherwise with Us. The accompanying friend or carer must purchase a place on the Excursion and be included in Your booking.  We endeavour to accommodate everyone and to make Excursions as inclusive as reasonably achievable.

 

Entertainment

We do not accept any liability for the non-appearance of any artist or the  cancellation/closure/withdrawal/curtailment/change of any event/parade/play/entertainment/ride or other planned activity on the Excursions for whatever reason. Should any of the aforementioned situations arise, the Excursion will still proceed as planned.  We are not obliged to inform You of any such cancellation. We will however endeavour to inform You of any such cancellations if We are in the position to do so.  Such alterations will not constitute a significant alteration to an Excursions and no compensation or refund will be provided.

 

Third Parties

Our Excursions are often comprised of services from independent third parties. Those third parties provide these services in accordance with their own terms and conditions. Third parties’ terms and conditions are available on request. We are not liable for the services provided by a third party.

 

Complaints

If You have a complaint during an Excursion, please immediately inform the designated Tour Manager/Our Driver, who will do their best to address the issue there and then. If the issue is not resolved, You must notify Us within 14 days of the Excursion in writing to Tessa Palmer, 19 Leyden Street, London, E1 7LE. All complaints will be acknowledged once received. We endeavour to address or resolve Your complaint within 28 days of the complaint being received. Failure to notify Us of Your complaint as detailed above may impact the outcome.

 

Trip Insurance

We highly recommend that You have appropriate insurance in place for Your bookings. It is Your responsibility to ensure that Your insurance is suitable and adequate for the bookings You have made with Us.

 

Pricing Policy

The prices shown in Our Media are not guaranteed, we regularly update prices depending on known costs, inflation and other factors.

We have the liberty to alter an Excursion price as and when we deem it necessary. When You book an Excursion with Us, the price confirmed at the time of your booking is final and will not change.

 

Our Liability

The Company do not accept any liability for any loss, damages or delay whatsoever that occur from Your use, access or engagement with Our Services. Except where prohibited by law, by using the Website and accessing, using or engaging with the Services you indemnify and hold harmless the Company and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Website or your violation of these Terms and Conditions. We are not liable in contract, tort (including negligence), breach of statutory duty, or otherwise for any indirect, direct or consequential loss or damages arising under or in connection with the Services or any contract between You and Us.

In no event shall the total liability of the Company, its affiliates or any of their respective directors, officers, employees, agents, Companions or service providers to You, for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from the Services and any contract between You and Us, the use of, or the inability to use, the Website and/or the Services exceed, in the aggregate GBP £100.00. We will not be responsible for any injury, death, illness, loss, damage, expense, cost or claim of any description whatsoever arising from any of the following: the acts and or omissions of You or a member of Your booking or the acts or omissions of a third party which were not foreseeable or unavoidable. We do not accept responsibility for any services that do not form part of the Excursion. This includes for example refreshments purchased throughout the day where the services were not arranged as part of the Excursion.  All arrangements for meals, refreshments, entertainment or other means of travel such as ferry/train are made by Us as agents for or on behalf of You on the condition that the Company shall not be responsible for any loss, damage, delay or inconvenience caused to You as a result of such arrangements.

 

Assistance

All of Our Excursions are fully accompanied, this means that an individual from the Company will be with You throughout the Excursion, should you require or request it, and where availability permits it. This does not mean that We are responsible for You throughout the day.  You should only book and attend an excursion if you are fit and well enough to do so.

 

Behaviour

We reserve the unconditional right to refuse Your booking or to terminate Your booking in the event that We consider Your behaviour or conduct to be unreasonable and/or likely to cause damage, distress or nuisance to Us, other clients, employees, property or to a third party. If Your conduct is or is considered by Us to be a breach of statutory regulations then You will be removed from the vehicle. In the event that You are removed from the vehicle, Your booking will be terminated with immediate effect. If Your booking is refused or terminated, Our obligations to You as detailed in these Terms and Conditions cease immediately and We will be under no obligation to provide You with a refund or compensation for any loss which You may have incurred. We reserve the right to seek compensation in the event of any cost incurred by Us as unreasonable behaviour by You.

 

Your Data

You agree that Your Data will be processed in accordance with Our Privacy Policy.

 

Intellectual Property

All content and material published and made available by Us is the property of the Company. This includes but is not limited to, images, text, logos, documents, downloadable files and anything that contributes to the composition of the Company and the Website. Although every effort has been made to publish original material, if any person suspects that they own the copyright for any material shared by Us please contact Us. The Company may remove or modify the material on the Website at its discretion, afterward, the Company will hold no further liability for any third-party material available on the Website.

The Company prohibits the unauthorised use of any material created or made available by Us. Unauthorised use includes but is not limited to, imitation, storing, alteration, transferring, transmitting or posting any material that belongs to the Company or is suspected to belong to the Company without the prior written consent of the Company.   Any Media available on the Website has been created by the Company for marketing and information purposes. Any individuals in the Media are models. You understand that your experience with the Company may not be similar / the same as the Media and that the Media was intended to create an impression only.

 

Unless you explicitly express otherwise, you accept that any views or content you share with the Company may be reproduced by the Company on the Website and/or other business-related publications. By accepting this, you grant the Company the copyright to this material. You agree that the company has an indefinite, non-terminable, non-exclusive, sub-licensable right and license to use, publish, re-create, alter, transmit, transfer and share your views and content without the need to pay royalties or license fees for each use, copy or publication. The Company shall have no liability for any reproduced views or content that you have shared on the Website or with the Company that you do not have the right to share. Should the Company incur any legal fees or other expenses as a result of your views or content not being your original work, then you agree to indemnify the Company for these costs.

 

General

These Terms and Conditions shall be governed by and construed in accordance with the laws of England. If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid. If there is a conflict between these Terms and Conditions and/or any other policies or specific terms of use appearing on this Website, the Company is entitled to decide which shall prevail.
